In these terms and conditions, the following definitions apply:

  • “Eskapadi” means our company, Eskapadi, and any of its employees, officers, directors, or agents.
  • “Client”, “you”, or “your” means any person who purchases or uses our services, including any of your guests or invitees.
  • “Services” means any travel arrangements or activities provided by Eskapadi, including but not limited to tours, excursions, transportation, and accommodations.

General Terms

By booking any of our services, you agree to the following terms and conditions:

  • You are at least 18 years old and have the legal capacity to enter into a contract.
  • You have read and understood these terms and conditions, and you agree to be bound by them.
  • You agree to pay the full amount for the services you book, in accordance with our payment policy.
  • You agree to provide accurate and complete information when booking our services, including your contact information and any special requests or requirements.
  • You agree to comply with all applicable laws, regulations, and policies when using our services, including but not limited to immigration, customs, health, and safety requirements.
  • You acknowledge and accept the risks and limitations associated with travel, including but not limited to accidents, injuries, illnesses, property damage, and loss of personal belongings.

Contract

The Contract governs the legal relationship between Eskapadi and any individual who travels or plans to travel on a tour organized by Eskapadi. The Contract, and all issues arising from it, are subject to the laws of Madagascar and the exclusive jurisdiction of the Malagasy courts. No representative or employee of Eskapadi, except for an authorized administrator, may alter or waive any of the terms herein, or offer any discount or refund outside the scope of this agreement.

Our bookings are tailored to your requirements and so bookings are subject to availability. Before a booking is confirmed, you will be sent an email attaching a proposed itinerary with full details of the trip. Once you have confirmed to us that you are happy with the proposal, we will proceed to take payment and issue you with an invoice. Please check that all names are the same as the relevant passport, that dates and the international flight timings and all other elements of your trip are correct. Where this is not done and there is an unreasonable delay in notifying any apparent discrepancies in the confirmed arrangements, you will be responsible for any additional charges that may arise as a result of alterations that have to be made to the booking.

A binding contract between the company and you (the lead name on the booking) is only formed when we issue you with our booking confirmation after having received payment from you, in cleared funds, of either the required deposit or the full price of your vacation (depending on when the booking is made relative to the intended departure date). By making the booking you accept that you have the authority to bind all members of your party to these terms and conditions of booking and you take responsibility as the lead name on the booking to make payment and to receive documentation on behalf of your party.

Price, Currency and payment

Price
We reserve the right to alter the prices of any trips shown on our website or set out in our written proposal to you at any time before your booking is confirmed. You will be advised of the current price before your booking is confirmed. Prices quoted are Euro prices based on daily currency exchange rates current at the time of quotation.

The price of your experience is inclusive of taxes and where applicable, all additional fees and charges and other costs. Where any costs cannot be reasonably calculated by us in advance of the conclusion of your contract, we will give you an indication at the time of booking of the type of additional costs which you may still have to bear.

Currency
If there is a substantial alteration in the exchange rate that impacts the expense of your tour, Eskapadi reserves the right to  modify the price to reflect the change. Nevertheless, we will notify you of any adjustments and explore the available alternatives with you.

Payment
In all cases, in order to make a booking, a deposit will be required. The following conditions apply:

  • Services costing an invoice total of less than €2,500 must be paid in full upon reservation.
  • For services costing an invoice total of more than €2,500, payment must be made according to the following conditions:

If the booking is made more than 21 days before the start of the tour, one of the following payment terms will apply (at our discretion):

  • 50% of the tour cost is due upon reservation,
  • The balance of 50% must be received by us no later than 21 days prior to the commencement of your tour.


For tours that entail significant upfront payment requirements,such as helicopter or private plane hire, we may require different payment terms and where bookings include flights with airlines that require full payment in advance of booking, the full price of the flight(s) will be included in the booking deposit.

Regardless of other matters, we require full payment to be received in our bank account 21 days before the commencement of the tour.
If, following the payment of a deposit at the time of booking, any balance remains unpaid within 21 days of the intended departure date, we reserve the right not to issue travel documentation and treat your booking as canceled. In such circumstances cancellation charges will be applied as set out.

Payments must be made in the currency of the invoice and you will be responsible for any bank charges that may be incurred.

Payment Methods
At present, Eskapadi provides two payment options:

  • Wire transfers to our designated bank account are accepted for all clients paying from outside of Madagascar. The bank details will be provided at the time of booking. You are responsible for paying any fees related to the transaction charged by your bank or any intermediary banks. Regardless of the reason for such fees, the full invoice amount must be received net in our bank account. By accepting these terms, you agree to pay any underpayments and settle the balance in full prior to the start of your holiday.
  • For Malagasy residents or clients booking within Madagascar, payment in cash in Ariary is accepted.

Please note that we cannot accept cash or card payments for clients booking from outside of Madagascar.
We reserve the right to modify our payment terms for unusual services or during high demand periods, such as group bookings in peak seasons or when we are required to make advance payments outside of our usual service provider agreements.

It is a requirement for all clients to purchase a comprehensive travel insurance policy that provides coverage before, during, and after the trip. Eskapadi will not be held liable for any expenses incurred by clients or their party due to inadequate or inappropriate travel insurance coverage.

Clients have the sole responsibility of arranging their own insurance and ensuring that they have adequate coverage for the entire duration of their tour. This includes coverage for medical expenses, injury, death, repatriation, cancellation, and curtailment, as well as any delays or cancellations caused by COVID-19. clients are advised to carefully review their insurance policies to ensure that there are no exclusion clauses that may limit coverage for the activities included in their tour. It is recommended that clients purchase insurance at the time of booking their tour to increase the likelihood of coverage in the event of changes or cancellations.

Liability insurance

Eskapadi has limited insurance coverage, and we do not trust Malagasy insurance companies to adequately pay for claims made against them. The client acknowledges and accepts that there may be no policy covering Eskapadi for liability to its clients for death, injury, damage, or loss occurring anywhere in the world. It is possible that passenger accident liability cover may be limited or non-existent. The client acknowledges that Eskapadi has taken reasonable steps to safeguard itself from liability in the challenging Malagasy business environment, but it will always act responsibly to protect clients from harm within its capabilities.

While Eskapadi holds various insurance policies, this booking condition states that the client must assume they are not covered by any of Eskapadi’s insurance policies, including liability insurance for death, injury, damage, or any other loss. The client
acknowledges that Eskapadi will not entertain claims for any of those risks

Ultimately, it is your responsibility to ensure that you and your party can obtain and possess all necessary travel documents/visas in advance of travel. You must have a valid passport with at least six months’ validity and three blank pages, relevant visas for your entire holiday, and vaccination certificates required for your entire holiday.

It is also your responsibility to ensure that you and all members of your party can comply with all health formalities for the destination concerned. We will not accept liability if you or any member of your party is refused entry onto any transport or into any country due to your/their failure to carry correct documentation or comply with relevant health formalities.

Not all trips and activities are suitable for individuals with disabilities, reduced mobility, or medical conditions. If you or any member of your party have any disability, reduced mobility, or medical condition, it is crucial to inform us before booking to ensure that the travel experience you’re interested in is appropriate and safe for your needs. We will make the necessary arrangements to ensure that your experience is safe and seamless.

All health and mobility information will only be used to advise you regarding your booking and to pass on to suppliers of your travel experience.

AMENDMENTS AND CANCELATION

Amendment, transfers and cancellation by you

Any cancellation or amendment request must be sent to us by email to welcome@eskapadi.mg  and will not take effect until received by us.

Amendment

In case you wish to make changes to your travel arrangements after we have issued our booking confirmation, we will try our best to assist you. However, please note that we cannot guarantee that we will be able to make the changes. You must submit your
request for changes in writing and an administration charge of EUR 150, in addition to the costs incurred in making those amendments, may apply.

Please be aware that certain service providers, such as Madagascar Airlines – Tsaradia, may charge fees for date changes, and some services may be priced differently from your original quote. It is your responsibility to cover these fees and any price differences.

It’s important to note that the tickets we purchase are standard economy class, which are non-refundable and non-modifiable. Changes made to your schedule after confirmation may result in forfeiting the ticket and purchasing a new one. However, we can book modifiable tickets for you at an additional cost if you request it.

Transfers

It is possible for you to transfer your booking to another person who meets all the requirements of the travel contract. To do so, you must provide written notice to us at least 15 days in advance. Please note that any additional fees or charges resulting from the transfer will be passed on to you and you will be advised of these costs before the transfer is made. An amendment fee of EUR 150 will also be charged for any transfer. It is important to keep in mind that both you and the person to whom you transfer your booking will be jointly responsible for paying any outstanding balance as well as any additional fees or costs.

Please be aware that some scheduled airlines, such as Madagascar Airlines – Tsaradia, may apply 100% cancellation charges and may not allow name changes or other modifications to bookings. In these cases, a transfer may be treated as a cancellation and a new booking. If you are considering making any changes to your booking, please contact us and we will inform you of any applicable charges.

Cancellation

If you decide to cancel your booking, please be aware that cancellation charges will apply. The cancellation policy differs based on the invoice amount as follows :
For invoices of €2,500 or more, each payment made during the payment process will become non-refundable immediately.
For holidays that cost less than €2,500, full payment is due upon invoice, and we offer no refund in case of cancellation.

Please note that our refunds policy is stringent. From the moment we receive each payment from you, we begin paying certain suppliers and incurring costs that are non-refundable. Therefore, we cannot refund any unused services included in your holiday package, even if you cannot participate due to uncontrollable circumstances like weather or personal reasons. We advise clients to make informed decisions about their
holiday before booking.

It’s important to note that once we pay a hotel or a service provider in Madagascar, we are bound by their terms and conditions. This means that even if you need to cancel or postpone your trip due to events like COVID, border closure, or road closure, we may not be able to accommodate your request without incurring penalties imposed by the service provider. Please understand that these penalties are imposed by the service provider, not by Eskapadi.

AMENDMENTS AND CANCELLATION BY THE COMPANY

Amendment

We reserve the right to make changes to your travel itinerary and will inform you of any modifications that may affect your booking. In some cases, we may need to make minor alterations to your itinerary, which we will communicate to you. If circumstances beyond our control force us to make significant changes to your travel services before the start of your package or we cannot accommodate your special requirements, we will inform you promptly. You will have the option to either accept the proposed changes or purchase a substitute package if available within the timeframe we specify.

We book scheduled flights as published by airlines, and we cannot be held liable for airline unreliability in Madagascar. In the event of a flight schedule change or cancellation, we will offer alternative dates, transport means, or routes, and we are available 24/7 to assist you in making the required changes. Please note that alternative dates, routes, or transport means may result in additional costs, which will require immediate payment from you.

Unavoidable and Extraordinary Circumstances

Unavoidable and extraordinary circumstances means a situation beyond the control of a party the consequences of which could not have been avoided even if all reasonable measures had been taken by that party (“Unavoidable and Extra rdinary
Circumstances”). Unavoidable and Extraordinary Circumstances will usually include, but are not limited to, war, threat of war, airport closures, airspace closures (as well as other air traffic management decisions which may give rise to long or overnight delays or cancellations of one or more flights), serious security problems such as riots, civil disturbance or unrest due to political instability or terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, significant risks to human health such as outbreak of serious disease at the travel destination, natural or nuclear disaster, fire, flood, drought, earthquake, or adverse weather conditions (actual or threatened).

Clients must make their own arrangements for international travel, including holding a valid ticket out of Madagascar. Failure to do so may result in refusal of entry to Madagascar, for which Eskapadi will not be held responsible. clients are also responsible for communicating their international travel itinerary to us and informing us of any changes. However, we do not accept liability for any missed or delayed international flights, and any unexpected costs resulting from changes will be borne by the client. Our tour booking terms and conditions regarding changes or cancellations will apply. We advise clients to ensure that all necessary travel, passport, visa, and insurance documents are in order and to arrive at the airport well in advance of check-in. Reconfirmation of flights may be necessary, and clients should request this from us at least 72 hours before departure, taking note of any relevant reference numbers or contacts.

Snorkeling & Diving

Madagascar is a top destination for snorkeling and scuba diving, offering crystal-clear waters, diverse marine life, and stunning coral reefs. During this time, humpback whales migrate from Antarctica to the warm waters off Madagascar to mate, give birth and nurse their calves. Visitors can witness these majestic creatures breaching, tail slapping and performing other impressive displays. Some of the best locations for whale-watching in Madagascar include the Ile Sainte Mariea, Nosy Be and Ifaty.
